ROBBERY

Robbery allegations require the State to prove beyond a reasonable doubt that the person caused bodily injury to another, or placed a person in imminent fear of bodily injury, while in the course of committing a theft. Robbery is a second degree felony in the State of Texas with a punishment ranging from 2 to 20 years in the Texas Department of Corrections.

In order for the State to obtain a conviction for Burglary, they must prove beyond a reasonable doubt that the defendant entered into a building or habitation, not then open to the public, with the intent to commit a felony, theft, or an assault. Violation of the burglary statute in the State of Texas is a state jail felony if the defendant entered a building. State Jail felonies carry a punishment range of 6 months to 2 years in a Texas State Jail facility. If the defendant enters the habitation of another, the offense under the burglary statute is moved to a second degree felony with a punishment range of 2 to 20 years in the Texas Department of Corrections.
